MotoStats / Terms of Use

Terms of Use

Riding a motorcycle is dangerous. MotoStats records and reviews your riding. It does not tell you how to ride, and it never makes riding safer.

1. Agreement

By downloading or using MotoStats (“the app”), you agree to these terms. The app is licensed to you under Apple’s Standard Licensed Application End User License Agreement, and these terms add to it. If you do not agree, do not use the app.

2. Who can use the app

You must be legally allowed to ride the motorcycle you use the app with, and hold any licence that requires. If you are under 18, you may use the app only with the permission of a parent or guardian.

3. You ride at your own risk

You are solely responsible for how you ride, for every decision you make on the road or track, and for your safety and the safety of others. You must obey all road rules, speed limits and laws that apply to you, ride within your ability and the conditions, and wear appropriate protective gear.

4. No encouragement of dangerous riding

MotoStats does not encourage, promote or reward speeding, racing on public roads, stunts or any unsafe or illegal riding. Figures such as top speed, lean angle and personal bests are records of what happened, not targets. The Ride Score is designed to reward smooth, controlled riding with grip kept in reserve, never speed or lean. Track features are intended only for closed circuits at organised events, following the venue’s rules. Nothing in the app is a challenge, competition or instruction to ride in any particular way.

5. Don’t use your phone while riding

Set up, calibrate and start recording before you ride. Do not look at, touch or operate your phone while moving. Use a secure mount and make sure it does not interfere with your control of the motorcycle. Follow local laws about phones and mounts.

6. Estimates only — no guarantee of accuracy

Every figure in the app, including lean angle, speed, distance, acceleration, braking, g-forces, corner speeds and bend size, road surface, lap times, fatigue, ride scores, and personal bests, is an estimate worked out from your phone’s sensors (accelerometer, gyroscope, GPS). We do not guarantee that any figure is accurate, complete or reliable.

Accuracy depends on things outside our control, including your phone model and its sensors, how securely and how straight the phone is mounted, calibration, vibration, GPS signal and surroundings (tunnels, trees, buildings), battery and power settings, the road, and how you ride. Figures can be wrong, delayed, inconsistent between rides or devices, or missing altogether.

The app is for general information and personal interest only. Do not rely on it for safety, riding decisions, vehicle or tyre setup, maintenance, training, racing, legal, insurance, accident reconstruction or any other purpose. It is not a speedometer, lap-timing system or measuring instrument and must not be used as one. The fatigue check is not medical advice; stop and rest whenever you feel tired.

7. Third-party services

Maps are provided by Apple. We don’t control this service and aren’t responsible for its availability, accuracy or content.

8. Your data

Your rides are stored on your device and you are responsible for keeping backups of anything you want to keep. How the app handles data is described in the Privacy Policy.

9. No warranty

The app is provided “as is” and “as available”, without warranties of any kind, express or implied, to the maximum extent permitted by law. We do not warrant that the app or any information it shows will be accurate, reliable, complete, uninterrupted or error-free, that it will work on your device or mount, or that recordings will not be lost.

10. Limitation of liability

To the maximum extent permitted by law, the developer of MotoStats is not liable for any death, personal injury, property damage, vehicle damage, fines, penalties, loss of data, or any direct, indirect, incidental, special or consequential loss or damage arising from or related to your use of, or inability to use, the app, including any reliance on, or inaccuracy in, any figure or information it provides. Where liability cannot be excluded but can be limited, it is limited, at our option, to supplying the app again or paying the cost of doing so.

11. Your consumer rights

Nothing in these terms excludes, restricts or modifies any right or remedy, or any guarantee, warranty or other term or condition, implied or imposed by law that cannot lawfully be excluded or limited. This includes the Australian Consumer Law and the mandatory consumer protection laws of the country where you live, such as those of the EU and UK. Nothing in these terms limits liability for death or personal injury caused by our negligence, or for fraud, where the law does not allow that liability to be limited.

12. Indemnity

To the extent permitted by law, you agree to indemnify the developer against any claim, loss or cost arising from your riding, your breach of these terms, or your breach of any law while using the app.

13. Changes

We may update these terms. The current version is always on this page, and continuing to use the app after a change means you accept it.

14. Governing law

These terms are governed by the laws of Queensland, Australia. If you live elsewhere as a consumer, you keep the protection of any mandatory laws of your country and may bring proceedings where you live if those laws allow.

15. General

If any part of these terms is found to be unenforceable, the rest stays in effect. Apple is not responsible for the app or these terms; they are between you and us.
